These Terms of Service ("Terms") govern your use of novitara.com and any services provided by Novitara ("we", "us", or "our"). By engaging with our services, you agree to the terms below.
1. Services Provided
Novitara offers website design, development, hosting, copywriting, CRM integration, digital marketing, and client portal services. All services are subject to availability and may evolve over time.
We may grant login access to certain systems including CRM, analytics, or automation tools. These systems are powered by third-party platforms and are subject to their terms of use as well.
2. Payments & Refunds
All service setup fees are non-refundable

Ongoing services (e.g., monthly hosting or management) are billed on a recurring basis and may be canceled with written notice before the next billing cycle.
We do not require long-term contracts. However:
Clients may not export their site or content to another white-label serviceClients requesting to move to their own platform may incur a setup and transfer fee at Novitara’s discretion.
3. Ownership & Access
Novitara retains ownership of all assets, content, and site infrastructure until full payment is received.
Clients will receive access to use and manage the site and associated tools. Exporting or duplicating the build to other platforms may be limited by licensing or technical constraints.
4. Acceptable Use
You agree not to use our services or platform access for unlawful, abusive, or unethical activities.
We reserve the right to deny or terminate service relationships at our sole discretion, particularly for industries that conflict with our brand standards.
Prohibited client categories include but are not limited to:
Adult content or pornographyHigh-risk businesses (e.g., firearms, gambling, multi-level marketing)Content that is hateful, exploitative, or misleading
5. Subcontractors & Tools
We may use subcontractors or third-party tools (such as Stripe, Google, Go High Level, or other platforms) to deliver services. Any outsourcing will be disclosed before work begins.
We are not liable for the performance, outages, or policy changes of third-party systems we integrate or rely upon.
6. No Guarantees
While we aim for exceptional results, we do not guarantee any specific outcome related to search rankings, traffic volume, lead generation, or financial performance.
7. Termination
Either party may cancel ongoing services with written notice. Termination does not entitle the client to refunds for work completed or setup fees.
Novitara reserves the right to revoke access for non-payment, abuse of services, or breach of these terms.
8. Limitation of Liability
Novitara will not be held liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability will not exceed the total amount paid for services rendered.
9. Changes to Terms
We may update these Terms periodically. Continued use of our services constitutes acceptance of any revised Terms.
10. SMS Terms & Conditions
By opting in to receive SMS messages from Novitara, you agree to the following:
1. Program Description: Novitara may send service-based messages, including appointment confirmations, account information, and important updates. With your separate consent, we may also send occasional marketing or promotional messages related to our services.
2. Opt-Out Instructions: You can cancel the SMS service at any time by replying “STOP” to any message. Upon receiving your request, we will confirm your unsubscribe status via SMS, and you will no longer receive text messages from us.
3. Rejoining Instructions: To resubscribe, simply opt in again through our website or by texting “START” to our number.

5. Carrier Liability Disclaimer: Carriers are not liable for delayed or undelivered messages.
6. Message and Data Rates: Message and data rates may apply for messages sent to and from us. Message frequency may vary based on your interactions with Novitara.
